TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICHEVER IS GREATER).
You agree to indemnify, defend, and hold us (and our officers, directors, employees, agents) harmless from any claims, losses, liabilities, damages, costs (including attorneys' fees) arising from your User Content, violation of these Terms, or misuse of the Service.
We may suspend or terminate your access immediately, without notice, for any breach or at our discretion. Upon termination, your license to use the Service ends, but certain provisions (e.g., licenses granted, indemnification, disclaimers) survive.
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of laws principles.
Any disputes arising from these Terms or the Service shall be resolved exclusively through binding arbitration in Detroit, Michigan, under the rules of the American Arbitration Association (or successor). You waive class actions and jury trials. This does not prevent either party from seeking injunctive relief in court.
